Ruth Bader Ginsburg, now a Supreme Court justice, wrote this legal brief in 1970 when she was director of the ACLU’s Women’s Rights Project. The Supreme Court’s unanimous ruling in Reed v. Reed was the first time the Court held that the 14th Amendment prohibited discrimination based on sex. Susan Reed had challenged an Idaho law that automatically granted her former husband the right to administer their deceased son’s estate.
