    Supreme Court, Melbourne Port Phillip, March 23rd 1843. Sir, I do myself the Honor to enclose for your information and that of His Excellency the Governor the Port Phillip Gazette newspaper of the 18th instant containing in substance, the opinion I have given from the Bench respecting the "Melbourne Incorporation Act"; and to add that the case was forwarded by me to their Honors the Judges in Sydney for their decision, according to the provision of the local act of 5 of Victoria, recently confirmed by Her Majesty. I beg leave again to state that I have never been favored by any information respecting His Excellency's "Instructions" and am therefore ignorant of the precise circumstances under which the Bill was promulgated as Law. I am aware however of the general nature of the Royal Instructions accompanying the commission of a Colonial Governor with
