This police report, written by Constable Bracken on the 6th of July 1880, is as interesting as it is important. Addressed to the Officer in Charge at Benalla, the report dispels the theory that Martin Cherry a civilian present at the Glenrowan Inn was shot by Ned Kelly. Brackens report, along with the annotations made overleaf by Inspector Montfort, irrefutably state that Cherrys death was indeed a result of police gunfire. Dr. Nicholson, who examined Cherry, also reached the same conclusion stating that the victim was lying down when shot. The names on the left-hand side margin are names belonging to witnesses who state the same claim. Once the report left Benalla it was forwarded to the Chief Commissioner in Melbourne.
